Islamabad: Supreme Court of Pakistan has disposed of the Suo Motu notice regarding death of 11 years old child namely Asfand Yar along with his father and three others in the incident of Drag Race held in Rawalpindi on 05.12.2010. A three- member bench of the apex court comprising Chief Justice Iftikhar Muhammad Chaudhry, Justice Tariq Pervaiz and Justice Amir Hani Muslim heard the case on Tuesday.
The Acting Advocate General Punjab (AGP) Muhammad Hanif Khatana appeared before the court submitted a detailed report. He informed the court that additional session judge of Rawalpindi has declared these killing as incidental deaths and the case of murder has been finished and another case under section 322 has been registered.
Hanif informed the court that the compensation has been given to the heirs of deceased, adding that the heirs have compromised with the accused but the compromise has not been made with two accused namely Majid Naeem and Sheikh Atif.
Sheikh Atif who is the close relative of Tariq Aziz’s relative. Tariq Aziz was the principal secretary of fromer president. Sheikh Atif is in Dubai and has taken relief from a court of Dubai and he could not be brought to Pakistan.
During the hearing the well known lawyer leader Hamid Khan represented the Bahria Town. According to the decision by SC this case would proceeded further in trail court. The suo moto case has been disposed off in about one year period.
