Sindh High Court (SHC) has given permission Muhajir Quami Movement Haqiqi (MQM-H) chief Afaq Ahmad to pursue his cases, meanwhile, Chief Justice SHC Mushir Alam has nominated Sindh High Court Bar’s President and Secretary for his assistance.
MQM-H chief appeared before two single member benches of SHC comprising Chief Justice Mushir Alam and Justice Maqbool Baqir on Friday.
Earlier, Afaq appeared before the bench of Justice Maqbool Baqir, who heard a murder case regarding pre arrest bail. Afaq told the court that the police had involved him in nine different cases, whereas all fake cases registered against him were concluded in 2007.
The court ordered the Assistant Prosecutor Muhammad Abdullah to pledge that no new case would be registered against Afaq Ahmad.
Justice Baqir said that the defendant is being victimized with undue cases without keeping in view the very consequence, adding that prima facie all steps against Afaq have been taken maliciously and it should be assured in written that no new case would be registered against Afaq.
Prosecutor told the court that Afaq Ahmad had not been arrested in the under trial current case, adding that Afaq name is in column 2 because several people were killed on his directives.
At this, the court asked from where the new case did appear. Justice Maqbool Baqir commented that the issues should not be taken easy, with the direction that Afaq Ahmad should not be involved in any case.
Court maintained that if assistant prosecutor can not deal with matters than Prosecutor General Shahadat Awan should appear before the court and court summoned prosecutor general, meanwhile the court was informed that prosecutor general is not present in the city.
The court ordered the Prosecutor General to appear in the count on next hearing. Later further hearing was adjourned till November 15.
Later, Sindh High Court Chief Justice Mushir Alam conducted hearing of the plea filed by Muhajir Qaumi Movement’s chairman Afaq Ahmad against MQM Chief Altaf Hussain, stating that a case of his party leader Akhtar Hussain murder should be registered against Altaf.
During the course of hearing CJ asked that whether he had taken services of any counsel?
Afaq Ahmad replied the court that he was being threatened from different people, adding that one of his counsels had been gunned down. That is why no counsel was ready to provide him legal services and he himself would argue the case, he said.
Chief Justice Mushir Alam said that every citizen has right to defend himself and permitted Afaq to argue his cases.
Meanwhile Afaq requsted to CJ that he may be heard in-chamber because he wants to share some information regarding the situation. He said that he has been forced to leave the country since Musharraf era. I would not leave country and collogues because I born in Karachi, he added.
He said that murderers and dacoits are being protected on the name of reconciliation and whole Karachi has been made hostage.
The Chief Justice deferred the hearing of case, nominating SHC Bar President and the Secretary Bar for assistance of Afaq.
