Balochistan High Court (BHC) during the hearing of Mastung Target killing case, has issued notices to President Supreme Court Bar Association (SCBA) Asma Jahangir on her statement regarding Suo moto powers of HC.
A division bench of BHC comprising of Chief Justice Qazi Faiz Essa and Justice Hashim Khan Kakar heard the suo moto notice on Monday, taken by CJ BHC on killing of 29 pilgrims by unknown persons, when they were on way to Iran by bus in Mastung.
The provincial officials submitted the report regarding the incident, in which it was stated that provincial government has decided that no one would be allowed to travel without NOC.
Court maintained that the president SCBA has given statement about the suo moto notice powers of the High Court, so notices may be issued to president SCBA for the description about the issue that whether the court enjoys or not suo moto powers.
BHC directed to the police and FC officials to submit the maps and other record about the target killing of pilgrims.
The court accepted the petitions for hearing filed by the Hazara Democratic Party, Pakistan Bar Council and Balochistan High Court Bar Association for becoming the party in target killing case.
During the course of hearing the Advocate General Balochistan appeared before the court and informed that an inquiry committee has been constituted under the supervision of provincial interior secretary, adding that the inquiry of the incident has been given to the CIA police.
Chief Justice Faiz Essa remarked that provincial government is destroying the province, adding that when the Levies Force is not eligible to investigate into the matter than why the control of the Mastung has been given to Levies force.
CJ remarked that the provincial government is responsible for these kind of incidents, adding that inexperienced police officials are not responsible for the current situation of the province. What kind of steps are being taken by the provincial government to protect the lives and property of masses CJ inquired.
Justice Kakar said that Levies force heard the voice of firing and why not went to the spot, adding that why police has not recorded statement of any eyewitness. Later court adjourned the further hearing of the case till October 04.
