The most affected individual after divorce are the children who see how their family is torn apart, the worst thing for them is that they will either end up with their mother or father.
But what is the Islamic ruling on the custody of children? To whom Shariah gives the custody of children? The question was asked from Sheikh Saalih who answered the question in detail.
Sheikh said that until the children are not mature and capable of thinking for themselves they will be handed over to their mother. It has been also observed that children are more attached to their mothers.
But if the mother marries to someone else then the custody will be given to father because when a woman asked the Prophet (PBUH) for the custody of the children he said: “You are more entitled to him so long as you do not get married.” Sunan Abu Dawood (2276)
